A Practical look at gender based differences when it comes labour law
Predominantly, in most societies, both men and women have to work to overcome the economic instability. So, a woman working in the means financially assist her family or her passion. However, they perform different chores and tasks which has difficult impacts and outcomes in general. Working women play multiple roles in their family surroundings. They face hard times as women in the common workforce. Every government has a set of special laws to protect women, who are in the employment market. In Sri Lanka, the industry-wise labour act s and laws are performing various types, such as Shop and office and Wages boards. Those laws monitored by the labour department of Sri Lanka.
Commonly known, the women who were work in overnight (above the 10.00 pm) is subject to approved in Sri Lanka. Further, the women are prohibited to do masculinely works as per the law Labour law of Sri Lanka (2006).
As per the Shop and Office act, If any women work overnight in an organisation should get the prior approval from Labour Commissioner to works over 10.00 pm, even that cannot exceed more than ten-night work shifts. The overnight works can be allocated to a woman worker during one in a month. both genders are entitled to equal pay and equal opportunities have to given by the employer. Further, gender-based discrimination and recognition are not allowed by the law Rajapakshe (2019)
In the recent past, gender-based discrimination is moderately lower than the other Asian countries, because of the average education level of Sri Lankans are scored more than 97% World bank (2016). The education level is key to the knowledge and path to overcome problems in a proper way it is either male or female.

But, in reality in working women, life is much different than law and the imagination. Cultural embedding plays a crucial role in shaping the definition of work. The social and cultural conditions accorded to women, superstitious beliefs and religious sanctions are influencing in working women as in south Asian countries. Because of women has takes considerable weighted roles and responsibilities into the family life of socio looking in Sri Lanka.

However, the laws and social look at the female worker is practically different. The employment opportunity and labour market have dominated by males because of that, social structures are given an adverse effect on female employees. I would remember that famous adverse experience case of the USA, Bill Clinton and Monica Lewinsky In this case, Monica has faced very bad experience in her entire life than the Clinton, even she is living in an advanced social community TED (2015). So, we can assume gender equality is how much questionable in reality.
The garments are becoming a key income generator and sharing a higher amount of GDP to Sri Lanka's export market. So, the country has encouraged female workers to take part in it. So, employees are hired by different societies and various places for work. Garments have been managed with high bureaucracy and limited shared authority levels Apeksha, (2015). The number of department bodies and larger employees was under one roof. The large employee groups as segmented into small teams.
Meanwhile, the immediate supervisor is representing and responsible person for a team. So, the immediate supervisor is taken power misbehaviour on his team and harassments on female employees. However, the garments have well structured with policies and controls, if they found any complaints or guilty on their employees, immediately they have terminated the employment contract of both parties without making any queries. The commitments and family responsibilities are keeps employees silence. So, most of the misconduct cases were not comes under HR awareness and employee complaint ratio is comparably low. Because most of the garment employees work to overcome their economic instability. The HR strategies and vision have failed under a large group of employee circumstance. Even whistle-blowing policy is active in most of Sri Lankan organisations. But in the victims of these cases are not ready to complain about the problems they faced.
In my personal view is, whatever the laws and regulations formed by the ruling government or authorities are no matter to who have ready to break or surpass the common rights and willingness. The actual personal integrity is only remedying for this type of misconducts and harassments. The high delegation and authority have inducing the respected personnel misuse the power as they want.

you are absolutely right,Available data reported from developing countries indicate similar gender differences worldwide: women have significantly higher rates of arthritis, osteoporosis, diabetes and hypertension than men.
ReplyDeleteWe are always depending on the law and orders but those can be stopped up to some extend only. Women will to be come forward to beat this issue not by their valor but by their competency. Some organizations have few role models to honor women. They can lose their religion if they don't see a person like themselves being promoted to leadership status. An increase in the number of women in power can have a meager effect encouraging other women to reach executive levels. For example, YouTube CEO Susan Zicky, as a Harvard computer science graduate and sixteenth Google employee, she climbs the ladder of technology. ReplyDeleteMostly the gender based issues creates in Asian countries since the gender equalization is very poor in Asian countries. But in most of the western countries there are no separate labour law for women. Basically it can be happened due to cultural differences.
